What Can You Be Compensated for in Workers’ Comp?

Edison Workers Compensation Lawyer

In New Jersey, workers’ compensation can provide you with certain financial benefits after suffering a work-related injury or illness. These benefits can include:

  • Medical benefits that cover all reasonable and necessary treatment and rehabilitation
  • Temporary disability payments that provide partial wage replacement for lost income when an employee cannot work or work in their normal role or hours due
  • Permanent partial disability benefits, which provide financial payments based on a worker’s average wages, affected body part(s), and severity of disability
  • Permanent total disability benefits that continue partial wage replacement after temporary disability benefits end, for as long as an employee remains unable to rejoin the workforce due to disability
  • Death benefits for the surviving family of a worker who has died due to a work injury or occupational illness, which include partial wage replacement and financial contributions toward funeral and burial expenses

How to File a Workers’ Compensation Claim in NJ

If you have been injured on the job in Edison, NJ, filing a workers’ compensation claim begins with notifying your employer of your work injury. Notice to an employer must be given within 14 days of a work accident to be entitled to benefits from the date of injury. However, to maintain eligibility for benefits, an injured worker must notify their employer no later than 90 days after the date of injury.

Workers may provide oral or written notice of their injury to their employer. An injured worker may notify a supervisor, manager, HR or safety department representative, or other individual in a position of authority with the company. Many employers or their workers’ compensation insurers will have forms that workers can fill out to fulfill their notice requirements.

When an employer is notified of an employee’s workers’ compensation claim, the employer or its insurer is required to file a first report of injury with the Division of Workers’ Compensation. The employer or its insurer is also required to process the worker’s claim within 60 days. If an employer does not file a report with the Division, denies a worker’s claim, or terminates benefits, the worker must file a written claim petition with the Division within two years. A claim petition allows a worker to pursue mediation of their claim in an informal hearing with a workers’ compensation judge, or to obtain a binding ruling following a formal claim hearing before the compensation judge. A claim petition also allows an injured worker to collect financial compensation for their permanent disability or injury.

About Edison, NJ

Edison is a township located in Middlesex County, New Jersey. The fifth-most populous municipality in New Jersey, Edison was originally incorporated in 1870 as Raritan Township, reflecting the community’s place near the core of the Raritan Valley Region. However, the township changed its name to Edison in 1954 in honor of inventor Thomas Edison who maintained his famous laboratory in the township’s Menlo Park neighborhood. Today, Edison is one of New Jersey’s fastest-growing communities and frequently ranks as one of New Jersey’s and the county’s safest and top places to live.

OSHA’s workplace accident records show that between 2017 through 2021, Edison experienced a total of two work-related fatal accidents, one of which involved a motor vehicle accident and the other involved a fall from height.

Frequently Asked Questions about Workers’ Compensation in Edison

How much does it cost to hire a workers’ compensation lawyer?

Can I collect additional compensation for my work injury outside of workers’ comp?

Who pays for workers’ compensation?

In New Jersey, most employers are required by state law to provide workers’ compensation coverage for their eligible employees. Employers can fulfill this requirement either by obtaining a certification from the state to “self-insure” for workers’ compensation liability or by purchasing insurance coverage from a third-party insurer. When an employer obtains a workers’ compensation insurance policy, the insurance company will be responsible for paying benefits to employees who file claims.

Can part-time or seasonal employees receive workers’ comp?

Yes. Workers’ compensation coverage is available to all employees who work for compensation, including part-time, seasonal, and under-18 employees. Part-time and seasonal employees can even receive benefits for other jobs that they work if their work injury or illness prevents them from being able to do that job.
